Chartopia is not operated by a corporation but by two individuals under the name d12dev. This Terms of Service is intended to provide clarity on the relationship between you and d12dev.

1. User Accounts and Membership

If strange things happen with your account, we may deactivate or delete it.

You must provide accurate and complete information when creating an account.
You are solely responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
You must notify us immediately of any unauthorized access or security breach.
d12dev may suspend or terminate accounts for violation of these Terms, inactivity, security concerns, or other reasons in our sole discretion.
You may not re-register for our Services if your account has been terminated for violations of these Terms.

2. User Content

You own your data, but give us permission to use it on d12dev so that we can provide our apps and services to you.

You retain ownership of all content you submit (“Content”).
By submitting Content, you grant d12dev a non-exclusive, worldwide, royalty-free license to use, copy, store, transmit, display, and perform such Content solely for the purpose of providing the Services.

There's no guarantees that d12dev can keep 100% uptime. We encourage you to backup your data.

You are responsible for maintaining your own backups of Content.
d12dev performs internal backups for administrative purposes only and does not guarantee recovery or integrity of data.
d12dev is not liable for loss or corruption of data.

6. Links to Other Websites

d12dev takes no responsibility for links to other sites, or sites that link to us.

The Website may contain links to third-party websites.
d12dev is not responsible for the content, accuracy, or practices of third-party websites.
Accessing third-party websites is at your own risk.

7. Advertisements

There may be ads.

Any correspondence, promotion, or transaction with advertisers is solely between you and the third party.
d12dev has no liability for interactions with third-party advertisers.

8. Prohibited Uses

Please show good community spirit while using d12dev apps and services.

d12dev reserves the right to suspend or terminate accounts for violations.

d12dev may suspend or terminate accounts for violations, inactivity, security risks, or other reasons.
Termination may occur with or without notice, depending on severity.
Upon termination, you must cease use and delete all credentials and Content.
Obligations relating to confidentiality, data protection, and liability survive termination.

13. Modifications to Services

We might change the Website or Services from time to time.

d12dev may modify or discontinue services, features, or functionality at any time without liability.

14. Force Majeure

Sometimes things happen outside our control.

d12dev is not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, technical outages, or governmental actions.

15. Dispute Resolution

If there is an issue that can't be resolved by talking with us, then any legal process has to be done in New Zealand.

These Terms are governed by the laws of New Zealand, without regard to conflict-of-law rules.
Courts in New Zealand have exclusive jurisdiction.
Users waive any right to jury trial.
United Nations Convention on Contracts for the International Sale of Goods does not apply.
